0. Operator
sanemos-pro (pro.sanemos.ai) is a professional portal operated by [Operator], domiciled in the Republic of Chile. Contact: contacto@sanemos.ai.
1. Purpose and acceptance
These Terms govern access to and use of sanemos-pro by mental-health professionals ("the Therapist"). By creating an account, the Therapist confirms they have read and accepted these Terms, the Privacy Policy, and the Data Processing Agreement (DPA).
2. Nature of the service
sanemos-pro is a software tool for licensed professionals to manage their practice: scheduling, patient records, intake forms, session notes, video calls, templates, billing, and AI-assisted summaries. The Operator does not provide clinical care, does not diagnose or treat, and is not a party to the therapeutic relationship between the Therapist and their patients.
3. Eligibility
The Therapist declares: (a) being licensed to practice in their jurisdiction; (b) that the credential, license, and training information provided is truthful and current; (c) compliance with the ethical and professional-secrecy duties of their profession. The Operator may request verification and suspend accounts with false information.
4. Account and security
The Therapist is responsible for credential confidentiality and all activity under their account, and must promptly report any unauthorized access.
5. Subscription, trial, and payments
Portal access may require a subscription processed by Flow (Chilean payment processor), in Chilean pesos (CLP). A 15-day trial is offered when the paywall mode is active. During the beta phase access may be free; the active mode is shown in the platform. The subscription auto-renews unless cancelled before the period ends. The Therapist may cancel anytime from settings; cancellation stops future renewals and does not refund the current period unless required by law. Payment data is handled by the processor; the Operator does not store full card numbers.
6. Therapist responsibilities for patient data
The Therapist is the data Controller for the patient data they enter or manage on the platform. They must: (a) have a legal basis and/or patient consent; (b) enter only necessary data; (c) maintain professional secrecy; (d) honor their patients' rights. The Operator's processing on the Therapist's behalf is governed by the Data Processing Agreement (DPA).
7. AI features
The platform offers AI-generated summaries and aids (e.g., patient-progress summaries). These outputs are supporting drafts, may contain errors, and do not constitute diagnosis or clinical judgment. The Therapist must review them and is solely responsible for clinical decisions. Text is processed as described in the Privacy Policy and DPA.
8. Video calls
Video calls are provided via LiveKit. Sessions are not recorded unless both parties consent; where recording exists, its storage is governed by the DPA.
9. Intellectual property
Software, brand, and design belong to the Operator. Clinical records and content the Therapist creates remain under their ownership and responsibility; the Therapist grants the Operator only the license needed to provide the service.
10. Limitation of liability
To the maximum extent permitted by Chilean law, the Operator is not liable for: the Therapist's clinical decisions; accuracy or suitability of AI outputs; content entered by the Therapist; or interruptions due to technical causes, maintenance, or force majeure. The service is provided "as is" and "as available".
11. Suspension and termination
The Operator may suspend or terminate access for breach, non-payment, or fraudulent use. On termination, patient data is returned or deleted per the DPA.
12. Modifications
The Operator may modify these Terms with at least 15 days' notice. Continued use after the effective date constitutes acceptance.
13. Governing law
These Terms are governed by the law of the Republic of Chile; disputes are subject to the ordinary courts of Santiago, unless a different jurisdiction applies for the benefit of the consumer.
